As of Sept. 30, 2021, California introduced the ABC testing exemptions to its law aimed at regulating the classification of independent contractors through AB 5. AB 5 needs a test that is divided into three subsections. This test is also commonly referred to as the ABC test. The test plays a role in helping determine if the labor force is made up of independent contractors or employees.
When an organization qualifies for exemption from an ABC test, employers must reverse and move towards old multifactor determination methods for worker classification. All exceptions for the adaptations were meant to commence from Jan. 1, 2022.Adapted Exemptions
